Prop 60/90


Proposition 60 allows qualifying “senior” citizens to transfer their property tax base from their current principal residence to a replacement property within the same county(intra-county) in CA if certain requirements are met.

Proposition 90 provides for those qualifying for Proposition 60 to transfer their property tax base to a replacement principal residence in another county(inter-county) in CA, under specific county ordinances. Counties that have ordinances enabling Proposition 90:

  • Alameda, El Dorado, Los Angeles, Orange, Riverside, San Bernadino, San Diego, San Mateo, Santa Clara, Ventura (counties subject to change without prior notice)


Elgibility

  • The replacement home must be your principal residence
  • One of the property owners must be at least 55 years old on the day of transfer of the original  principal residence
  • The replacement home must be of equal or lesser value than the original principal residence (inflation allowances may apply)
  • The replacement home must be purchased or built within two years of the transfer of the original  principal residence
  • Once you have filed and received this tax relief, neither you nor your spouse who resides with you can ever file again

It is generally safer to sell your principal residence first, under either of these two propositions, so you are better prepared to meet the requirements and your options may be clearer.

Filing

Claim form BOE-60-AH (Claim of Person/s at Least 55 Years of Age for Transfer of Base Year Value to Replacement Dwelling) is available from several sources and can be downloaded from most CA County's Assessor's webites

  • A claim must be filed within three years of purchasing or completing construction of the replacement property. If a claim is filed after the three-year period, relief will be granted beginning with the calendar year in which the claim was filed.
